4. KEY PRINCIPLES
We care about the Personal Information entrusted to us and are committed to processing it in a fair, transparent and secure manner. To this end, MODERN FORMS Ltd. applies the following principles:
Lawfulness: we will only collect and process your Personal Data in a lawful, fair and transparent manner. All Personal Data shall be collected, stored and processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR: General Data Protection Regulation).
Data minimization: we will limit the collection of your Personal Data to what is adequate and necessary to achieve the purposes for which it was collected.
Purpose limitation: we will only collect your Personal Data for specified, explicit and legitimate purposes and will not process your Personal Data in a manner incompatible with those purposes.
Correctness: we ensure that the Personal Information we hold is correct and up to date.
Security and data protection: to ensure an adequate level of security and data protection, we implement technical and organizational measures, taking into account, among other things, the nature of the Personal Data to be protected. Access and rectification: we will process your Personal Data in a manner that ensures that you can confirm whether we are processing your Personal Data, and that you can access your Personal Data and obtain the information you have requested along with a request to rectify your Personal Data in accordance with your rights.
Limited retention period: we will retain your Personal Information in a manner consistent with applicable data protection laws and regulations and for no longer than is necessary to fulfill the purposes for which it was collected or as required by law.

9. HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION

We will retain your Personal Data only for as long as necessary for the purposes for which we process your Personal Data or for compliance with the law or where retention of your data for a certain period is required by law. We have put in place an appropriate set of technical and organizational measures to ensure that your Personal Data is protected against accidental or unlawful destruction, loss, modification, unauthorized disclosure or unauthorized access to your Personal Data. These have been specifically designed taking into account our IT infrastructure, the potential impact on your privacy and associated costs, and in accordance with current industry standards and practice.
Your Personal Data may be subject to processing by a third party Data Processor only if that Data Processor commits to these technical and organizational data security measures.
Maintaining data security means protecting the confidentiality, integrity and availability of your Personal Data:
- Confidentiality: we will protect your Personal Data from unwanted disclosure to third parties.
- Integrity: we will protect your Personal Information from modification by unauthorized third parties.
- Availability: we will ensure that authorized parties are able to access Personal Information as needed.
Our data security procedures include: access security, backup systems, systems monitoring, review and maintenance, security incident management and business continuity assurance, etc.
11. USE OF COOKIES OR SIMILAR TOOLS

2) remembering the Products added to the basket in order to place an Order (essential cookies),
3) remembering data from completed Order Forms, surveys or login data to the site (essential and/or functional/preferential cookies),
4) adapting the contents of the site to the individual preferences of the Customer (e.g. color, font size, page layout) and optimize the use of the site (functional/preferential cookies),
5) conducting anonymous statistics showing how the site is used (analytical and performance cookies),
6) remarketing, i.e. studying the characteristics of visitors’ behavior by anonymous analysis of their actions (e.g. repeated visits to specific pages, keywords) in order to create their profile and provide them with advertisements tailored to their interests, also when they visit other sites in the advertising network of Google Ireland Ltd. and Facebook Ireland Ltd. (marketing, advertising and social networking cookies).

- The Administrator may use Google Analytics and Universal Analytics services provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). These services help the Administrator keep statistics and analyse web traffic. The collected data is aggregated. Administrator using the above services collects data such as the source and method of obtaining visitors to the site and their behavior on the site, information about the devices and browsers from which they visit the site, IP and domain, geographic data and demographic data (age, gender) and interests.
- It is possible to prevent a user from sharing information about his or her activity on the website with Google Analytics. For this purpose, you can install a browser add-on provided by Google Ireland Ltd. https://tools.google.com/dlpage/gaoptout?hl=en.
- The Administrator may use the Facebook Pixel service on the website provided by Facebook Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland). This service helps the Administrator to measure the effectiveness of advertisements and to find out what actions visitors take on the website, and to display tailored advertisements to these visitors. Please note that the third party recipients listed in (b) and (c) above – particularly service providers who may offer products and services through services or applications or through their own channels – may collect Personal Information from you separately. In such case, these entities are solely responsible for the processing and control of such Personal Data, and your interactions with them will be subject to their terms and conditions.

If you purchase a product or service from us (MODERN FORMS Ltd.) or if you provide us with your Personal Data, you thereby establish an intrinsic relationship with us as Data Controller and Administrator.

If you use MODERN FORMS Ltd. via www.themodernforms.com, www.modernforms.eu, www.medals24.com, www.awards-trophies.eu with a specific social media login (for example, Facebook account), MODERN FORMS Ltd. will register your Personal Data available on these social media, and your use of such social media means that you have expressly consented to the transfer of Personal Data registered by MODERN FORMS Ltd. through the tools of that social media.
MODERN FORMS Ltd. sometimes facilitates the publication of Personal Information through social media such as Twitter and Facebook. Social media have their own privacy policies, which you must take into account if you use such social media. We remind you that publishing content on social media may have certain consequences, including for your privacy or the privacy of the individuals whose Personal Information you share, such as not being able to withdraw the published content within a short period of time. You are fully responsible for what is published by you. MODERN FORMS Ltd. assumes no responsibility in this regard.
15. TRANSFER TO COUNTRIES OUTSIDE THE EEA
Your Personal Data may be transferred to recipients who are located outside the EEA and may be Processed by us and recipients outside the EEA. In connection with any transfer of your Personal Data to countries outside the EEA, MODERN FORMS Ltd. will implement appropriate measures to ensure an adequate level of protection for your Personal Data. 17. LEGAL INFORMATION
The requirements of this Policy do not supersede any other requirements existing under data protection law. In the event of a conflict between the content of this Policy and the requirements of data protection law, data protection law shall prevail.
MODERN FORMS Ltd. may change this Policy at any time, e.g. in order to comply with current data protection legislation, due to decisions or other acts of state authorities, or in connection with the need to improve the provision of our services. 18. DEFINITIONS
In this Policy, the following terms have the following meanings:
- Data Controller / Data Administrator means the organization that determines the purposes of processing and the means by which your Personal Data is processed. Unless we inform you otherwise, the Data Controller is: Modern Forms Ltd. based in Dobrzechów 446b, 38-100 Strzyżów, Poland, registered in the National Court Register kept by the XII Economic Department of District Court in Rzeszów under number: 0000736418, tax ID: PL8191668858. Further information may be provided to you via a separate information obligation clause, which for example will be included in certain services (including communication services), electronic newsletters, reminders, surveys, offers, invitations to events, etc.
- Data Processor means the person or organization processing your Personal Data on behalf of the Data Controller.
- Data Protection Point of Contact means the person appointed by MODERN FORMS Ltd., as a Data Controller, where you can direct your questions or requests regarding this Policy and/or the Processing of your Personal Data and who will deal with such questions and requests. Unless you are informed otherwise, you may contact the Data Protection Point of Contact as described in Section 3 „Who can you contact with questions or requests?”.
- EEA means European Economic Area (= Member States of the European Union + Iceland, Norway and Liechtenstein).
- Personal Data means any information about an identified or identifiable natural person e.g. you or that indirectly identifies you, such as for example name, phone number, email address.
- Processing means an operation or set of operations which is performed upon your Personal Data or sets of such Data, whether or not by automated means, such as collection, recording, organization, organization, storage, adaptation or alteration, retrieval, accessing and all forms of use of Personal Data.
